Surrey Members had a Presentation by Barrister Lee Gledhill on the Court of Protection Procedures on 7 February 2008. He gave a very good outline of those procedures including giving pointers as to the various forms that could be used and how they could be used.
He pointed out that because the Court of Protection is a fairly new Court, although it is governed by The High Court Rules, the Court itself is subject to its own rules which are being amended all the time. Warning was given that the practice notes on the Court of Protection website should be constantly looked at in order to ensure practitioners are up to date with the practice as it changes.
Lee pointed out that when the new CPR rules were introduced several years ago, the Courts were understanding of the fact that all practitioners were on a learning curve and were tolerant of mistakes. It is hoped, he said, that the Court of Protection will be the same as everyone is learning but believes that in a year’s time or so, this will not be the case.
